1. Agreement to Terms

Welcome to FlowShorts. These Terms of Service ("Terms") govern your access to and use of the FlowShorts website at www.flowshorts.app and our AI-powered video generation and social media auto-posting services (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

2. Description of Service

FlowShorts provides:

• AI-powered generation of short-form vertical videos based on topics you provide
• Automated posting of videos to connected social media accounts (YouTube, TikTok, Instagram)
• Video scheduling and content management tools
• Analytics and performance tracking

Our Service uses artificial intelligence to generate scripts, voiceovers, images, and compile final videos. The quality and accuracy of AI-generated content may vary.

3. Account Registration

To use our Service, you must:

• Be at least 18 years old
• Create an account using Google OAuth
• Provide accurate and complete information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized access

You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription Plans and Billing

4.1 Plans

We offer the following subscription plans:

• Starter ($19/month): 8 videos per month, limited posting schedule
• Creator ($39/month): 30 videos per month, daily posting
• Pro ($69/month): 60 videos per month, multiple daily posting times

Annual plans are available at a discounted rate (2 months free).

4.2 Billing

• Subscriptions are billed in advance on a monthly or annual basis
• Payment is processed through DodoPayments
• Subscriptions automatically renew unless cancelled
• Video quotas reset at the beginning of each billing cycle
• Unused videos do not roll over to the next billing period

4.3 Cancellation and Refunds

• You may cancel your subscription at any time from your account settings
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for partial billing periods
• We may offer refunds at our sole discretion for extenuating circumstances

4.4 Price Changes

We reserve the right to modify our pricing. Existing subscribers will be notified at least 30 days before any price increase takes effect. Continued use after the price change constitutes acceptance.

5. Acceptable Use Policy

You agree not to use our Service to create, post, or distribute content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, or obscene
• Infringes on intellectual property rights of others
• Contains hate speech, discrimination, or promotes violence
• Is sexually explicit or pornographic
• Promotes illegal activities or substances
• Contains malware, spam, or phishing attempts
• Impersonates others or misrepresents your identity
• Violates the terms of service of YouTube, TikTok, or Instagram
• Is misleading, deceptive, or constitutes misinformation

We reserve the right to review content and suspend accounts that violate this policy without prior notice or refund.

6. Intellectual Property

6.1 Your Content

You retain ownership of the topics, ideas, and prompts you provide. For videos generated by our Service:

• You own the rights to videos generated for your account
• You grant us a license to process, store, and deliver your content
• You are responsible for ensuring your content does not infringe third-party rights

6.2 Our Service

FlowShorts and its original content, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute our Service
• Reverse engineer or attempt to extract source code
• Use our branding without permission
• Resell or sublicense access to our Service

6.3 AI-Generated Content

Content generated by AI (scripts, images, voiceovers) is created using third-party AI services. While you may use this content, you acknowledge that:

• AI-generated content may have limitations on copyright protection
• Similar content may be generated for other users
• You are responsible for reviewing content before publishing

7. Social Media Account Connection

When you connect your social media accounts:

• You authorize us to post content on your behalf
• You are responsible for complying with each platform's terms of service
• You may disconnect your accounts at any time
• We are not responsible for actions taken by social platforms (content removal, account suspension)
• You must have the authority to connect and post to these accounts

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

• Scheduled maintenance (we will provide advance notice when possible)
• Technical issues or outages
• Third-party service disruptions (AI providers, social platforms, payment processors)
• Events beyond our reasonable control

Video generation times may vary based on demand and AI service availability. Failed video generations due to technical issues do not count against your monthly quota.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLOWSHORTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, or business opportunities
• Loss of data or content
• Social media account suspension or termination
• Inaccuracies in AI-generated content
• Service interruptions or failures

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Merchantability or fitness for a particular purpose
• Accuracy or reliability of AI-generated content
• Uninterrupted or error-free operation
• Results or outcomes from using the Service
• Security or freedom from viruses

You acknowledge that AI technology has inherent limitations and may produce unexpected or inaccurate results.

11. Indemnification

You agree to indemnify and hold harmless FlowShorts, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Content you create or publish through the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of social media platform terms

12. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including:

• Violation of these Terms
• Violation of our Acceptable Use Policy
• Fraudulent or illegal activity
• Non-payment of subscription fees
• At our sole discretion

Upon termination, your right to use the Service will cease immediately. We may delete your data in accordance with our Privacy Policy.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date.

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the new Terms, please stop using the Service.

14. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law. You agree to waive any right to participate in class action lawsuits.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FlowShorts regarding the Service and supersede any prior agreements.
